Acknowledgement and acceptance of terms and conditions

By accessing, using or browsing this website you acknowledge that you have read, understood and agree to be bound by its terms, conditions disclaimers and limitations of liability ["Terms and Condìtions"]. Giftbox Express reserves the right to ammend or update such terms, conditions, disclaimers and limitations of liability without providing notice. By using this website you acknowledge that you have read and understood these Terms and Conditions. In the event of a violation of these terms and conditions, giftboxexpress.com.au reserves the right to seek all remedies available by law and in equity.

Disclaimer

All information provided on this website is done so in good faith. To the best of our knowledge the information is accurate and up to date. However, Giftbox Express and its directors, employees and consultants do not make any representation or warranty as to the accuracy or completeness of the information.

Liability

Any liability of Giftbox Express in connection with goods or services supplied to you shall be limited to:

in relation to goods; the replacement or repair of the goods, the supply of equivalent goods, the payment of the cost of replacing or repairing the goods or the payment of the cost of obtaining equivalent goods;and
in relation to services, the supply of the services again or the payment of the cost of having the services provided again.

By ordering a product from the giftboxexpress.com.au site you agree to the following terms of purchase

All prices on this site are shown in Australian Dollars and are inclusive of Goods and Services tax [GST].
Giftbox Express reserves the right to alter prices and offers without prior notice.
All orders made through this website are subject to confirmation and acceptance by Giftbox Express.
Giftbox Express reserves the right to accept, refuse or limit your order for any reason, including but not limited to the unavailibility of a product or errors in the prices and product descriptions.
All deliveries require a signature on receipt. Anyone at the delivery address who receives the goods will be assumed by Giftbox Express to be authorised to do so. This includes but is not limited to, a hotel or hospital reception or office secretary signing for receipt of delivery at the specified address.
Giftbox Express will not despatch goods until payment has been made in full and we are satisfied with the integrity of the order.
All order and delivery information should be provided to us with care and accuratley. Giftbox Express reserves the right to pass additional delivery charges on to you should re-delivery be required as a result of incorrect delivery details.
Giftbox Express is not liabile for any damages that may occur from the use of misuse of products sold on this site.

Currency disclaimer

All prices shown on this site are listed in Australian currency and all transactions are settled in Australian dollars [$AUD]. If you are ordering from a country other than Australia, and your bank account or credit card is held in a different currency, you can order by credit card and your currency will automatically be converted to Australian dollars when you complete the transaction. The conversion rate varies from day to day with the current exchange rate. Many banks also charge a small currency conversion fee, contact your bank or credit provider for details. The final charge to your card is made in Australian dollars and your bank or credit provider determines the ultimate conversion rate. Therefore we are not able to take responsibility if the final amount charged to your card differs slightly from any estimated conversions that we may we provide on this site or to you over the phone.

Risk

Giftbox Express will retain ownership of the products you order until you have made payment in full. All risk in the products will pass to you, the purchaser, on dispatch. You are responsible for any government imposed taxes, duties or other liabilities, or any additional charges that may be incurred as a result of your purchase. Giftbox Express is not responsible for any loss or damage to products caused via transit.

Cancellation by you

If you need to cancel an order please contact us on + 61 8 9383 22 33 during working hours [9am-5pm Monday to Friday, West Australian time]. Please note we are unable to cancel orders that have been prepared and are with our courier for delivery. The original amount paid will be refunded less an $11.00 administration fee. All refunds for orders are credited back to the credit card used for payment. Please allow up to 7 days for us to process your refund. Freight charges are not refundable.

Cancellation by us

We reserve the right not to provide goods or services or cancel orders at our sole discretion at any time and will not be held liable for loss or damage arising from the exercising of these rights.

Damaged or faulty goods

Your happiness is our number one priority. Much of our business is generated from word of mouth. We want you be be happy with your purchase as our business grows from satisfied customers. If there is any reason that you are not satisfied, please contact us immediatley. In the event that you receive a product that is damaged or faulty we will gladly organise a replacement [subject to availability] once we receive the faulty or damaged return at our cost. It is your responsibility to make sure that the goods are adequately packaged to avoid damage during return transit. You may return damaged or faulty goods within 10 days of receipt. If a product is later deemed to be faulty, normal warranty conditions for that product apply. It is the recipient’s responsibility to follow warranty instructions as specified by the manufacturer. To make a return please complete our returns form. Once received we will contact you by phone or email within 24 hours. Please note that we reserve the right to determine if a product is actually faulty.

Dispute policy

Any alleged discrepancies in relation to goods or services supplied by Giftbox Express must be notified to customer service within 24 hours of delivery. Giftbox Express will investigate such discrepancys but reserves the right to be the final arbiter in the event of any dispute.

All material found on this website may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way except for your own personal, non-commercial use. Requests for use of content should be addressed in writing to online@giftboxexpress.com.au

Fraud

Giftbox Express take credit card fraud very seriously. Any person found to have placed an order under a false name, with a fraudulently obtained credit card or without the consent of the card holder will be prosecuted to the full extent of the law.

Substitutions

Giftbox Express reserves the right to substitute products that are unavailable or out of stock. On the rare occasion that this happens we guarantee that the replacement item will be an appropriate alternative of equal or greater value.

Display items

Some photographs contain ‘display items’ such as biscuits, coffee, dishes, glasses etc. These are lifestyle props and are not included in the gift package unless clearly specified. All gift boxes and individual items are fairly described in the contents area of the product order screen.

Purchase of alcohol

Gift boxes cotaining alcohol can only be purchased by persons aged 18 years or over.

Applicable law

By accessing this site, you and giftboxexpress.com.au agree that all matters relating to your access to, or use of this web site shall be governed by the statutes and laws of the State of Western Australia.
